Terms of Service

1. Service description

LabelCheck.eu is an online service published by BVP France, a simplified joint-stock company registered in the Montpellier Trade Register under SIREN number 811 661 271 (contact: bph@bvp-europe.com), allowing users to verify the regulatory compliance of product labels (food, cosmetics, detergents, medical devices) through artificial intelligence analysis.

The service is accessible at https://labelcheck.eu.

The result provided by LabelCheck is a decision-support tool. It does not constitute a binding legal opinion and does not replace the advice of a lawyer, toxicologist or approved regulatory expert.

2. Access to the service

2.1 Freemium access

A partial analysis is accessible without creating an account. The user submits a label and receives an analysis preview. Full results require payment or a subscription.

2.2 Paid access

Access to full reports, history, multi-client features and the dashboard is conditional on subscribing to a paid plan (Pay-per-use, Monthly subscription or Agency plan).

2.3 Access conditions

The service is reserved for adults acting in a professional capacity, or for legally constituted legal entities. By using the service, you declare that you meet these conditions.

3. Pricing and payment

Current prices are displayed on the LabelCheck.eu homepage. All prices are expressed excluding tax (excl. VAT); applicable VAT is added at billing.

• Pay-per-use France: 39 EUR excl. VAT per analysis
• Pay-per-use European Union: 65 EUR excl. VAT per analysis
• Pay-per-use Worldwide: 95 EUR excl. VAT per analysis
• Pro subscription: see price displayed online, monthly billing
• Agency plan: on quote, from 359 EUR excl. VAT / month

Payments are processed by Stripe (Stripe Payments Europe, Ltd.), a secure payment service provider. BVP France does not store any credit card data.

All purchases are final. The right of withdrawal provided for in Article L.221-28 of the French Consumer Code does not apply to digital content provided immediately after payment and with the express consent of the user.

4. User obligations

The user agrees to:

• Provide accurate and up-to-date information when creating an account
• Not submit files containing sensitive personal data unnecessary for regulatory analysis
• Not use the service for unlawful, fraudulent or public-order-contrary purposes
• Not attempt to bypass the security, payment or access mechanisms of the service
• Not resell or redistribute generated reports without the express authorization of BVP France
• Respect the intellectual property rights of BVP France and third parties

5. Limitation of liability

BVP France strives to provide a quality service, but does not guarantee:

• The complete absence of errors in analyses generated by artificial intelligence
• The continuity or uninterrupted availability of the service
• The definitive regulatory compliance of a product based solely on the LabelCheck report

The liability of BVP France is limited to the amount actually paid by the user for the service concerned, to the extent permitted by applicable law. BVP France shall not be liable for any indirect damage, loss of revenue or commercial harm.

6. Intellectual property

All content on the LabelCheck.eu website (texts, logos, graphics, source code, algorithms, databases, generated reports) is the exclusive property of BVP France or its partners, and is protected by French and international copyright and industrial property laws.

The user has a personal, non-exclusive and non-transferable right of use over reports generated for their benefit under their subscription. Any reproduction, representation or distribution to third parties for commercial purposes is prohibited without prior written consent.

7. Personal data

The processing of users' personal data is governed by our Privacy Policy, compliant with the GDPR (Regulation (EU) 2016/679). By using the service, you acknowledge having read this policy.

8. Cookies

LabelCheck.eu uses cookies strictly necessary for the operation of the service (session, CSRF security). No advertising or third-party tracking cookies are placed without your explicit consent.

9. Applicable law and jurisdiction

These Terms are governed by French law. In the event of a dispute, and in the absence of an amicable resolution, the competent courts in Montpellier (France) shall have exclusive jurisdiction, unless otherwise required by mandatory law.

For any dispute with a consumer residing in the European Union, the European Commission's Online Dispute Resolution (ODR) platform is available at: https://ec.europa.eu/consumers/odr.

10. Amendments to the ToS

BVP France reserves the right to modify these Terms at any time. Users will be informed of any significant modification by email or notification on the service. Use of the service after notification constitutes acceptance of the new terms.
